Federal investigators said the man set up a doctor’s office and hired nurses and doctors to make visits, but could not afford to pay them and ended up visiting patients under his employees’ names, even though he was a doctor.

Patrick Lynch, 55, has pleaded guilty to the federal charges and faces a 48-month sentence imposed by District Judge Peter G. Sheridan, US Attorney Paul J. Fishman announced.

Lynch was sentenced today to 48 months in prison for illegally treating patients, prescribing drugs and ordering procedures while being a licensed physician with an Ocean County medical practice in a scheme of Medicare fraud, Fishman said in a news release.

According to the federal indictment, Lynch established the practice and hired doctors and licensed nurses to make visits. “Lynch then continued the business by posing as licensed professionals and using their names and government-issued identification numbers to write prescriptions and send fees to Medicare,” the indictment said.

Fishman said Medicare has received hundreds of requests for visits to older patients, most of them at home. One of the doctors who fell victim to identity theft was Dr. Andrew Nelson, Licensed Physician. Fishman said Lynch impersonated the licensed individuals and then visited and billed Medicare.

Lynch pleaded guilty to one count of aggravated identity theft and Medicare fraud — one charge each — and was sentenced to the following in addition to prison:

Judge Sheridan sentenced Lynch to two years of supervised probation and ordered him to pay Medicare $40,000 in compensation for payments he received from fraudulent bills he filed. The judge also ordered Lynch to attend alcohol/drug/psychiatric/gambling treatment and prohibited gambling and self-employment.
